These Terms govern your use of services provided by Agentic Solutions ("we," "us," "our"). By purchasing or using our services, you agree to these Terms. Please read them — they're written in plain English and they're fair.
Agentic Solutions provides website design, build, and hosting services for local service businesses. Our core offering includes:
Additional services (social media posting, SEO management, blog content, booking systems) are available as optional add-ons and are governed by separate agreements.
One-Time Setup Fee ($40): This covers website design, build, and initial deployment. Payment is processed securely via Stripe at the time of purchase.
Refund Policy: Because our service involves custom design work that begins immediately upon payment, we do not offer refunds once your site has been built and delivered to you for review. If you are dissatisfied before approving the final site, we will work with you to make it right.
Optional Growth Plan ($29–$199/month): If you choose a monthly add-on plan, you may cancel at any time before your next billing cycle. No partial refunds for mid-cycle cancellations. Your base website remains live after cancellation — you are only canceling the add-on features.
Price Changes: Your one-time setup fee is locked at the price you paid. We may change pricing for new customers at any time but will not retroactively charge existing clients more for their existing setup.
We host your website on our infrastructure at no recurring charge as part of your one-time purchase. We intend for this to be a long-term arrangement and have designed our business model to support it sustainably.
What "no monthly fee" means: You will not receive a monthly hosting invoice. There are no hidden renewal charges. The $40 you paid covers ongoing hosting under normal operating conditions.
Service Continuity Promise: If we ever need to discontinue hosting services — due to business closure, acquisition, or significant infrastructure cost changes — we will:
We will never simply shut down your site without notice or hold your content hostage. Your content is always yours.
Fair Use: Hosting is provided for normal small business website use. We reserve the right to limit or charge for hosting of sites generating unusually high traffic (over 100,000 monthly visitors) or storing excessive data (over 1GB of uploaded files) — and will always provide 30 days notice before doing so.
Your content is yours. Any text, photos, logos, or other materials you provide to us remain your property. We do not claim ownership over your business content.
Your website code is yours. Upon request at any time, we will provide you with a complete copy of your website's source code. You are free to host it elsewhere.
Our templates and systems: The underlying design templates, portal software, and automation systems we use to build and manage your site remain our intellectual property. You receive a license to use the finished website — you don't receive ownership of our internal tools.
Photos we source: For sites where we use stock photography (from sources like Unsplash), we use only images licensed for commercial use. If you later want to swap in your own photos, we strongly encourage it — real photos of your work always perform better.
Your client portal allows you to request updates to your website via a chat interface. Our system uses AI to process and implement your requests.
Standard Plan includes: Up to 10 update requests per calendar month. An "update" is defined as a single change request (e.g., update a phone number, add a photo, change operating hours).
Unused updates do not roll over to the following month.
What counts as one update: A message requesting one specific change. Uploading photos for a new project and asking us to add them to your portfolio counts as one update.
Over-limit requests: If you exceed 10 updates in a month, additional requests will be queued for the following month, or you may upgrade to a Growth Plan for unlimited updates.
Update accuracy: We use AI to implement changes and do our best to fulfill requests accurately. For complex structural changes, we may ask clarifying questions. We are not liable for minor errors in AI-generated content — please review changes after they go live and let us know if anything needs tweaking.
By using our service, you agree to:
You are responsible for the accuracy of the content on your site. We publish what you provide and what you approve. If your business information changes (phone, hours, services), update your site through the portal.
Your website must be used for lawful purposes only. The following are strictly prohibited and will result in immediate account termination without refund:

Content changes via portal: When you request a content update through your portal, you confirm that the requested content complies with this Acceptable Use Policy. We reserve the right to refuse any update request that we determine, in our sole discretion, violates this Policy.
We monitor for violations. We do not proactively review every piece of content on hosted sites, but we will act promptly on reports of violations. If we determine your site violates this Policy, we will:
Termination for violations is without refund. If your account is terminated due to an Acceptable Use Policy violation, you forfeit any amounts paid and are not entitled to a refund.
Reporting violations: If you believe a site hosted by us violates this Policy, please contact us at hello@agenticsolutionsusa.com. We take all reports seriously and will investigate promptly.
We're honest about what we can and can't promise:
To the maximum extent permitted by law, Agentic Solutions' total liability to you for any claims arising from our services shall not exceed the amount you paid us in the preceding 12 months (or $40 for one-time customers).
We are not liable for indirect, incidental, or consequential damages — including lost revenue, lost customers, or business interruption — even if we were advised of the possibility of such damages.
This limitation does not apply to damages caused by our gross negligence or willful misconduct.
You can leave anytime. Contact us at any time to cancel your account. We will provide your complete site files within 5 business days of your request.
If you cancel: Your website will be taken offline within 30 days of cancellation. Your portal access ends immediately. You keep all your content and code.
If we need to terminate your account: We may suspend or terminate accounts that violate these Terms (e.g., illegal content, spam). In such cases, we will provide 7 days notice where legally permitted, except in cases of serious violations where immediate action is required.
Data retention: After cancellation, we will delete your data from our servers within 90 days, after providing you an opportunity to download it.
We collect only the information necessary to provide our services: your name, business name, email address, phone number, and the content you submit for your website.
We do not sell your personal information to third parties. We use it only to build and maintain your website and communicate with you about your service.
Your website visitors' data (contact form submissions, etc.) is delivered directly to you. We do not store or access it beyond what is necessary to transmit it to you.
We use Stripe for payment processing. We never see or store your full credit card number.
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
Let's talk first. If you have a dispute with us, please contact us at hello@agenticsolutionsusa.com before pursuing legal action. Most issues can be resolved quickly and fairly through direct communication.
If we can't resolve a dispute directly, any claims shall be resolved through binding arbitration in Massachusetts, rather than in court, except that either party may bring claims in small claims court.
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect.
Your continued use of our services after the effective date of updated Terms constitutes acceptance of those Terms.
We will always keep previous versions of our Terms available upon request.

🚫 Your site must be used for a legitimate, lawful business. No illegal content, fraud, adult content, or anything sketchy — ever. Violations = immediate termination, no refund.
✅ If something goes wrong, email us first. We'll make it right.
